Ahead of the CLIMPACT Inaugural Conference, a presentation of Giuseppe Naglieri's new monograph, which traces the global itinerary of rights-based judicial review over the mitigation obligations of states and corporations. Reading systemic climate litigation comparatively across jurisdictions, the book shows how a shared repertoire of legal constructs — the positive obligation to mitigate, the fair share of a global carbon budget, the prohibition of regression — produces markedly different outcomes depending on a legal order's openness to international law, its judicial philosophy, the transnational networks mediating the circulation of arguments, and its legal culture. The itinerary runs from the European and North American courts where the systemic-litigation model first took shape, through Latin America and South and East Asia, and through the corporate cases reshaping mitigation obligations across the globe, to the regional and international courts — the European Court of Human Rights, the Inter-American Court, ITLOS and the ICJ — now consolidating a body of transnational mitigation law.
